WARRANTY / GUARANTEE INFORMATION SHEET

Global Wastewater Division (The Company) makes the following warranty to the initial retail purchaser of its products (the Customer).

Materials and Workmanship: The Company warrants products manufactured by it to be free from defects in materials and workmanship in normal use and service for a period of ten (10) years after date of delivery to the Customer. For foreign Customers, the date of delivery begins when the products arrive at the port of destination.

Company's Obligation and Customer's Exclusive Remedy: The Company's sole obligation and the Customer's exclusive remedy under this warranty is as follows:

Global Wastewater division with reference to the effectiveness of the Global Wastewater Treatment System and /or the effluent standards will make no warranty or guarantee. The systems commonly remove from 90-95% of the BOD5 and TSS. The Company does not offer a written guarantee because the system requires that it be properly installed; receive adequate maintenance; and be operated properly, items which The Company has no control over.

This warranty covers the equipment supplied by The Company but will not be valid if: (1) The system was improperly installed; and/or (2) Routine maintenance and operations are not performed in accordance with The Company Manual or (3) If the hydraulic load and/or organic loading, or other parameters, exceeds the design standards and criteria used and determined by The Company, with the initial design of the system.

A logbook or charts must accompany claims, prepared by a licensed, qualified and approved plant operator. The logbook is to have recorded data pertaining to the hydraulic loading, the organic loading, BOD5 TSS and Dissolved Oxygen and any other agreed upon criteria. The Company shall be relieved of any and all obligations under this warranty if the information is not presented. Conditions, Limitations and Exclusions: There are no warranties or merchantability or fitness for a particular purpose with respect to any product manufactured or sold by The Company. Motors & Blowers provided by The Company are in most instances warranted by the manufacturer thereof and are not warranted by The Company. The Company shall not be responsible under this warranty or otherwise for personal injury or for Incidental or Consequential Damages, including, without limitation, loss of use and lost profits. This warranty does not apply to defects or damages caused by misuse, improper maintenance, or improper installation of The Company's product. The Company reserves the right to make changes or improvements to its products without incurring the obligation with respect to previously manufactured products. Field modifications of this product without the expressed written permission of The Company constitutes as misuse of the product. The Company shall have no liability under this warranty until payment in full for the product in question has been made by the Customer. The foregoing is the sole warranty made by The Company. No one is authorized to make other warranties on behalf of The Company.
